Introduction

Welcome to 4Friday. These Terms of Service ("Terms") govern your engagement of our iOS mobile app development services. By contracting our iOS app development services, you agree to be bound by these Terms.

Please read these Terms carefully before engaging our services. If you do not agree with any part of these Terms, you may not proceed with our iOS app development services.

Our Services

4Friday provides comprehensive iOS mobile app development services, including:

• Custom iOS mobile app development using Swift and UIKit/SwiftUI
• Mobile UI/UX design following Apple's Human Interface Guidelines
• iOS app strategy and mobile app consulting
• App Store optimization and mobile app submission
• Post-launch app maintenance and ongoing mobile app support
• iOS app performance optimization and updates

All iOS app development services are provided according to the specific terms outlined in individual mobile app project agreements.

iOS App Development Agreements

Each iOS mobile app development project will be governed by a separate app development agreement that includes:

• Mobile app scope, features, and deliverables
• App development timeline and milestones
• Payment terms and schedule for app development
• iOS app intellectual property ownership
• App feature revision and change request procedures
• App Store submission and approval process

These Terms supplement, but do not replace, individual iOS app development agreements.

Payment Terms

App Development Payment Schedule

Unless otherwise specified in your iOS app development agreement:

• 50% deposit required before mobile app development commencement
• Remaining balance paid according to app development milestones
• Final payment due before iOS app delivery and source code transfer

Late Payments

Late payments may result in iOS app development suspension and additional fees. We reserve the right to charge interest on overdue amounts.

Intellectual Property

Client Ownership

Upon full payment, clients receive ownership of:

• Custom iOS app source code developed specifically for their mobile app
• Mobile app design assets and UI/UX elements created for their iOS app
• iOS app documentation and project deliverables
• App Store assets and marketing materials created for their mobile app

4Friday Ownership

4Friday retains ownership of:

• Proprietary iOS development tools and frameworks
• General mobile app development methodologies and processes
• Pre-existing iOS code libraries and reusable components
• Mobile app development templates and starter frameworks

Client Responsibilities

Clients are responsible for:

• Providing accurate iOS app requirements and timely feedback on app development progress
• Timely review and approval of mobile app design mockups and development milestones
• Providing necessary app content, images, and API access for mobile app integration
• Obtaining and maintaining required Apple Developer account ($99/year)
• Ensuring mobile app content compliance with App Store guidelines and policies
• Providing app testing feedback and user acceptance testing

App Feature Revisions and Changes

iOS app scope changes and additional app features beyond those included in the original mobile app development agreement may incur additional charges. All app feature changes must be approved in writing before implementation.

Warranties and Disclaimers

Our iOS App Development Warranty

We warrant that our iOS mobile app development services will be performed in a professional manner consistent with Apple's development standards. We provide mobile app bug fixes for 30 days after iOS app delivery at no additional cost.

Disclaimers

We do not guarantee:

• App Store approval (though we follow all Apple guidelines and best practices)
• Specific mobile app download numbers, user ratings, or revenue
• iOS app compatibility with future iOS updates without additional development work
• Third-party API or service availability or functionality within the mobile app
• Mobile app performance on jailbroken or modified iOS devices

Limitation of Liability

To the maximum extent permitted by law, 4Friday's liability for any claims arising from our iOS mobile app development services shall not exceed the total amount paid by the client for the specific mobile app project giving rise to the claim.

We shall not be liable for any indirect, incidental, special, or consequential damages related to mobile app performance, App Store issues, or business losses.

iOS App Development Termination

Either party may terminate an iOS app development agreement with written notice. In case of mobile app project termination:

• Client pays for iOS app development work completed up to termination date
• 4Friday delivers completed mobile app work and source code (upon payment)
• Both parties return any confidential app-related information
• Client retains rights to completed iOS app features and code (upon payment)

Mobile App Confidentiality

We maintain strict confidentiality regarding all iOS app development projects and app-related information. We are happy to sign NDAs before mobile app project discussions and maintain professional discretion regarding your app concept and business model at all times.

Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be resolved through the courts of England and Wales.

Changes to These Terms

We may update these Terms from time to time. We will notify clients of any material changes by posting the updated Terms on our website and updating the "Last Updated" date.
